These Terms govern your access to and use of the VerityVerse online store and related services.
These Terms of Use (the “Terms”) govern your access to and use of the VerityVerse website, storefront, checkout, related pages, digital features, customer service channels, and any products or services offered through them (collectively, the “Site”). By visiting the Site, placing an order, creating an account, submitting content, or otherwise using the Site, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, do not use the Site. If you are using the Site on behalf of a business or other entity, you represent that you have authority to bind that entity to these Terms.
You must be at least the age of majority in your place of residence, or have the consent and supervision of a parent or legal guardian, to use the Site. You may use the Site only for lawful, personal, and non-commercial shopping purposes unless we expressly agree otherwise in writing.
You may not misuse the Site, interfere with its operation, attempt unauthorized access, use bots or scraping tools without permission, submit false information, infringe intellectual property rights, or use the Site in a way that is fraudulent, abusive, defamatory, or unlawful.
We may update the Site, product offerings, pricing, content, and these Terms from time to time. Changes become effective when posted unless a later date is stated. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
We strive to display products, sizes, colors, framing options, previews, and descriptive information as accurately as possible. Even so, product images are illustrative, and variations may occur because of monitor settings, lighting, screen calibration, print processes, material differences, supplier tolerances, cropping, handcrafted finishing, or the natural characteristics of paper, wood, glass, acrylic, metal, and frame components.
Availability, product configurations, and pricing may change without notice. We do not guarantee that every product shown on the Site will remain available at all times.
Your order is an offer to purchase. An order confirmation or automated email does not mean we have accepted your order. We reserve the right to accept, decline, limit, or cancel any order in our discretion, including for suspected fraud, pricing or listing errors, product unavailability, fulfillment issues, suspected resale activity, or violations of these Terms.
By submitting payment information, you represent that you are authorized to use the selected payment method and authorize us and our payment processors to charge the full order amount, including applicable taxes, shipping, and any stated fees. We may use third-party providers to process and verify payments.
Prices are shown in the currency displayed at checkout and may change without notice before an order is placed. Unless expressly stated otherwise, prices do not include taxes, duties, customs charges, import fees, or similar governmental charges that may apply based on destination.
If we discover a pricing, product description, configuration, promotional, or typographical error, we may correct it and cancel or refuse the affected order, even after payment has been submitted. If an order is canceled after payment, we will issue an appropriate refund for the canceled amount.
Many VerityVerse products are made to order, printed on demand, framed to order, or customized based on your size, frame, text, finish, or other selections. You are responsible for carefully reviewing all details before completing your purchase, including spelling, punctuation, dates, verse references, personalization fields, size, frame selection, finish, crop preview, shipping address, and billing information.
Unless otherwise required by applicable law, orders for personalized, custom, made-to-order, framed-to-order, or print-on-demand products are final once submitted to production and are not eligible for cancellation, return, exchange, or refund because of buyer’s remorse, change of mind, ordering mistakes, style preference, size preference, color expectation, or similar subjective reasons.
Minor differences in placement, cropping, print density, texture, woodgrain, frame tone, mat alignment, or other production details that do not materially impair the product’s intended use are not defects.
Shipping and delivery timeframes are estimates only unless we expressly state otherwise in writing. Production time and transit time may vary by product type, destination, carrier performance, holidays, weather, customs review, supplier constraints, or other events outside our reasonable control.
If we cannot ship within the time stated at checkout or, if no time is stated, within the time required by applicable law, we may contact you to obtain consent for a revised shipment date or cancel the unshipped portion of your order and provide an appropriate refund as required by law.
You are responsible for providing a complete and accurate shipping address. We are not responsible for delays, losses, or extra costs caused by inaccurate addresses, failure to collect a package, missed delivery attempts, customs issues, or carrier events beyond our reasonable control.
You must inspect your order promptly upon delivery. If your order arrives damaged, defective, materially misprinted, or incorrect, you must notify us at support@verityverse.store within 7 calendar days after confirmed delivery and include your order number, a description of the issue, and clear photographs of the item, packaging, shipping label, and any visible damage.
If we determine that a product was damaged in transit, materially defective, or that we sent the wrong item, we may, at our option, replace the product, provide store credit, or issue a refund to the original payment method. We may require additional information before approving a claim.
Except where required by law or expressly stated in a separate written policy, we do not accept returns or exchanges for custom, personalized, made-to-order, or framed-to-order products, and we do not issue refunds for buyer’s remorse, accidental orders, incorrect size or frame selections made by the customer, dissatisfaction based on expected appearance alone, or requests made after production has begun.
If you initiate a chargeback or payment dispute without first contacting us and giving us a reasonable opportunity to review the issue, we reserve the right to present order records, production records, tracking data, correspondence, and other relevant evidence to the payment processor or financial institution.
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly if you suspect unauthorized use.
If you submit reviews, photos, testimonials, messages, feedback, or other content to us or through the Site, you represent that you own or control the rights necessary to provide that content and that it does not violate any law or third-party right. You grant VerityVerse a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, display, adapt, publish, and distribute that content for store operations, marketing, customer service, and promotional purposes, subject to applicable law.
The Site and its content, including artwork, product layouts, designs, text, logos, icons, graphics, photographs, downloads, compilations, and overall look and feel, are owned by or licensed to VerityVerse and are protected by intellectual property and unfair competition laws. These Terms do not transfer any ownership rights to you.
You may view and purchase products from the Site for personal use only. You may not copy, reproduce, modify, distribute, sell, create derivative works from, reverse engineer, or exploit any part of the Site or its content without our prior written permission, except as allowed by law.
From time to time, we may offer promotions, discount codes, gift cards, gift codes, or store credit. Such offers are subject to any additional terms provided with the offer and may be modified, suspended, or discontinued at any time. Promotions generally cannot be combined unless expressly stated.
The Site may contain links to third-party websites, applications, payment services, social media platforms, fulfillment services, or other tools. We do not control those third parties and are not responsible for their content, policies, performance, or practices. Your use of third-party services is at your own risk and subject to their separate terms and privacy notices.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND ALL PRODUCTS, CONTENT, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. WITHOUT LIMITING THE FOREGOING, WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING, COURSE OF PERFORMANCE, OR USAGE OF TRADE.
We do not warrant that the Site will be uninterrupted, error-free, secure, or free from viruses or harmful code, or that any product will perfectly match on-screen previews.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VERITYVERSE AND ITS OWNERS, AFFILIATES, LICENSORS, SERVICE PROVIDERS, CONTRACTORS, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO THE SITE, ANY ORDER, ANY PRODUCT, OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SITE, ANY ORDER, ANY PRODUCT, OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO VERITYVERSE FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US$100.00).
You agree to defend, indemnify, and hold harmless VerityVerse and its affiliates, service providers, licensors, officers, directors, employees, and agents from and against any claims, losses, liabilities, damages, judgments, settlements, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your misuse of the Site, your breach of these Terms, your violation of law, or your infringement of any rights of another person or entity.
Please read this section carefully. It affects your legal rights. Before either party starts arbitration or files a claim, the parties agree to try in good faith to resolve the dispute informally. You agree to first send a written notice describing the issue and the requested relief to contact@verityverse.store, and we will attempt to resolve the matter informally for at least 30 days.
Except for claims that may be brought in small claims court, disputes concerning intellectual property rights, or requests for injunctive or equitable relief to protect confidential information or intellectual property, any dispute arising out of or relating to the Site, any order, any product, or these Terms shall be resolved by binding individual arbitration administered by the American Arbitration Association under its applicable Consumer Arbitration Rules, unless another administrator is required by law.
Arbitration will be conducted on an individual basis. TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND VERITYVERSE WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, MASS ARBITRATION, PRIVATE ATTORNEY GENERAL ACTION, OR OTHER REPRESENTATIVE PROCEEDING.
If any portion of this arbitration or class action waiver section is found unenforceable as to a particular claim or request for relief, then that claim or request shall proceed in a court of competent jurisdiction, and the remaining portions of this section shall remain in effect to the fullest extent permitted by law.
These Terms and any dispute between you and VerityVerse will be governed by the laws of the State of Georgia, without regard to conflict of laws principles, except to the extent preempted by U.S. federal law. To the extent a dispute is permitted to proceed in court rather than arbitration, the state and federal courts located in or serving Fulton County, Georgia will have exclusive jurisdiction, and each party consents to personal jurisdiction and venue in those courts.
We will not be liable for delay or failure to perform caused by events beyond our reasonable control, including natural disasters, severe weather, fire, flood, war, terrorism, civil unrest, labor disruptions, utility failures, internet outages, carrier failures, customs delays, epidemics, governmental actions, or supply chain disruptions.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver. These Terms, together with any policies incorporated by reference, constitute the entire agreement between you and VerityVerse regarding the Site and supersede prior understandings relating to the same subject matter.
You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, financing, sale of assets, reorganization, or by operation of law.
